1. Introduction

These terms and conditions ("Terms") govern your use of the LeadRescue service ("Service") provided by LeadRescue ("we", "us", "our"). By signing up for or using the Service, you agree to be bound by these Terms.

2. The Service

LeadRescue is a missed-call text-back service. When a call to your designated phone number goes unanswered, the Service automatically sends an SMS to the caller on your behalf. The Service includes:

• Missed call detection and automatic SMS replies.
• A dashboard to view call and SMS history.
• Configurable business hours, SMS templates and caller settings.

3. Eligibility

You must be at least 18 years old and operating a legitimate business to use the Service. By signing up, you confirm that the information you provide is accurate and complete.

4. Your Account

You are responsible for maintaining the security of your account credentials. You must not share your login details with any third party. You are responsible for all activity that occurs under your account.

5. Pricing and Payment

• The Service costs £29 per month.
• Payment is processed securely through Stripe.
• Your subscription renews automatically each month unless cancelled.
• We reserve the right to change pricing with 30 days' notice.

6. Free Trial

If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged the standard monthly fee.

7. Cancellation and Refunds

• You may cancel your subscription at any time.
• Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial months of service.
• Upon cancellation, your access to the dashboard and Service will end at the close of the billing period.

8. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or marketing content beyond the agreed missed-call auto-reply.
• Violate any applicable laws, including UK telecommunications regulations.
• Harass, threaten or abuse any person.
• Transmit harmful, offensive or illegal content.
• Attempt to gain unauthorised access to the Service or its systems.

We reserve the right to suspend or terminate your account if you breach these terms.

9. SMS and Telephony

• SMS messages are sent through Twilio. Message delivery depends on carrier networks and is not guaranteed.
• You are responsible for ensuring your SMS template content complies with UK regulations and does not contain misleading or unlawful content.
• Standard SMS rates may apply to your customers' replies, depending on their mobile provider.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect your data.

11. Availability and Support

• We aim to keep the Service available at all times but do not guarantee uninterrupted access.
• We may perform maintenance that temporarily affects availability, and will aim to give reasonable notice.
• Support is available by email.

12. Limitation of Liability

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any lost revenue, missed business opportunities, or indirect damages arising from the use or inability to use the Service.
• Our total liability to you in any 12-month period shall not exceed the fees you have paid to us during that period.

13. Intellectual Property

All content, branding, software and materials associated with LeadRescue are our intellectual property. You may not copy, modify, distribute or reverse-engineer any part of the Service.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
